BY ACCESSING OR USING THIS WEBSITE OR OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL TERMS, DO NOT USE THIS WEBSITE OR OUR SERVICES.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and IRIS Autism and Developmental Services, LLC ("IRIS," "we," "us," or "our"), a North Carolina limited liability company, concerning your access to and use of our website and psychological assessment services.

By accessing our website, scheduling an appointment, or using our services, you represent that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms that may apply to specific services. If you are agreeing to these Terms on behalf of a minor child, you represent that you are the parent or legal guardian with authority to bind the minor to these Terms.

2. Description of Services

2.1 Scope of Services

IRIS provides comprehensive psychological assessments and testing services for children and adolescents. Our services are designed to evaluate developmental, cognitive, emotional, and behavioral functioning, with a focus on autism spectrum disorder (ASD), attention-deficit/hyperactivity disorder (ADHD), intellectual disabilities, and other developmental conditions. These services may include:

  • Initial consultations
  • Clinical interviews with parents/caregivers
  • Behavioral observations
  • Standardized psychological testing
  • Scoring and interpretation of assessments
  • Report writing and documentation
  • Feedback sessions to review results and recommendations

2.2 Limitations of Services

Our services are intended solely for diagnostic and clinical purposes. IRIS does NOT provide:

  • Emergency or crisis services
  • Ongoing psychotherapy or counseling
  • Medication management
  • Custody evaluations or recommendations regarding parental fitness
  • Forensic evaluations or expert witness services
  • Legal opinions related to any legal proceedings

IN CASE OF EMERGENCY:

If you or your child experiences a psychiatric emergency, please call 911 or go to your nearest emergency room immediately.

3. Eligibility and Client Responsibilities

3.1 Eligibility

Our services are available to children and adolescents as determined during the initial consultation. For clients under 18 years of age, a parent or legal guardian must provide consent for assessment services. In cases of divorced or separated parents, legal documentation confirming custody arrangements may be required.

3.2 Client Responsibilities

By using our services, you agree to:

  • Provide accurate and complete information during intake and throughout the assessment process
  • Provide current and accurate insurance information before your appointment
  • Complete all required intake forms at least 3 business days prior to scheduled appointments
  • Arrive on time for all scheduled appointments
  • Provide required documentation (e.g., custody agreements, prior evaluations) as requested
  • Comply with all applicable laws and these Terms
  • Treat IRIS staff with respect and professionalism

4. Appointments, Cancellations, and No-Shows

4.1 Scheduling

Appointments are scheduled based on availability. Assessment appointments typically involve multiple sessions, including initial consultation, parent/caregiver interview, in-person testing, and feedback session.

4.2 Cancellation Policy

To avoid fees, please provide at least three (3) business days' notice for cancellations. Cancellations with less than three business days' notice will incur a $200 cancellation fee. This fee is not covered by insurance and is your personal responsibility.

4.3 Late Arrivals

Any arrival more than 30 minutes late will incur an additional fee of $1 per minute beyond the 30-minute grace period. Significantly late arrivals may result in rescheduling of the appointment at IRIS's discretion.

4.4 Required Forms

Required intake forms must be completed online and submitted at least 3 business days prior to your scheduled clinician interview and testing appointment. Failure to submit forms may result in appointment delays or rescheduling.

5. Fees and Payment

5.1 Insurance

IRIS is in-network with various commercial insurance providers and North Carolina Medicaid. Insurance will be billed directly on your behalf when applicable. You are responsible for understanding your mental health benefits, including deductibles, co-pays, coinsurance, and coverage limits. Educational testing (e.g., for dyslexia or academic skills) may not be covered by insurance.

5.2 Payment Responsibility

You acknowledge and agree that you are financially responsible for all services rendered, regardless of insurance coverage. All co-pays, coinsurance, deductibles, and fees for non-covered services are due at the time of your child's scheduled testing appointment. IRIS accepts credit/debit cards, HSA/FSA, and other approved payment methods.

5.3 Insurance Denials

IF YOUR INSURANCE PLAN DENIES PAYMENT FOR SERVICES RENDERED, YOU UNDERSTAND AND AGREE THAT YOU ARE RESPONSIBLE FOR PAYMENT IN FULL.

Insurance billing does not guarantee payment, and all financial responsibility ultimately rests with you.

5.4 Assessment Reports

A detailed written assessment report will be provided within 2-4 weeks after the assessment is completed and all fees are fully paid. Reports will not be released until all outstanding balances are satisfied.

6. Legal Matters and Forensic Limitations

IRIS does NOT provide legal opinions, recommendations, or expert witness services related to custody disputes, family court matters, or any legal proceedings. Our psychological assessment services are intended solely for diagnostic and clinical purposes.

6.1 No Custody Recommendations

IRIS will not provide custody evaluations, make recommendations regarding parental fitness, or offer opinions related to custody or visitation arrangements.

6.2 Non-Forensic Policy

Our assessments are not designed for forensic use and should not be relied upon in legal proceedings. Any attempt to use our assessment reports or clinical opinions in legal matters is done without our endorsement or cooperation.

6.3 Court Testimony

IRIS clinicians will not appear in court or provide testimony unless required by a valid subpoena or court order. If compelled to testify, professional time related to legal matters will be billed at $500 per hour, including preparation, travel, waiting time, and testimony. This fee is your responsibility and is not covered by insurance.

6.4 Agreement Not to Subpoena

BY AGREEING TO THESE TERMS, YOU ACKNOWLEDGE AND UNDERSTAND THAT IRIS'S SERVICES ARE NOT INTENDED FOR LEGAL PURPOSES, AND YOU AGREE NOT TO SUBPOENA OUR CLINICIANS OR REQUEST OUR PARTICIPATION IN LEGAL MATTERS.

7. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of IRIS or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from our website without our prior written consent.

8. Website Use

8.1 Permitted Use

You may use our website only for lawful purposes and in accordance with these Terms. You agree not to use our website in any way that violates any applicable federal, state, local, or international law or regulation.

8.2 Prohibited Activities

You agree not to:

  • Attempt to gain unauthorized access to our website, server, or any connected databases
  • Interfere with or disrupt the integrity or performance of our website
  • Transmit any viruses, malware, or other harmful code
  • Use any robot, spider, or other automated device to access our website
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

Psychological assessment involves professional judgment, and results may vary based on individual circumstances.

9.3 Third-Party Links

Our website may contain links to third-party websites or resources. These links are provided for your convenience only. We have no control over the content of those websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IRIS, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use our website or services
  • Any conduct or content of any third party on our website
  • Any content obtained from our website
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL IRIS'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR WEBSITE OR SERVICES EXCEED THE AMOUNT YOU PAID TO IRIS FOR SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless IRIS, its owners, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of our website or services, or your violation of any third-party rights.

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim against IRIS, you agree to try to resolve the dispute informally by contacting us. We will attempt to resolve the dispute by contacting you via email or phone.

12.2 Arbitration

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or our services shall be resolved by binding arbitration in Guilford County, North Carolina, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

12.3 Class Action Waiver

YOU AND IRIS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Guilford County, North Carolina, and you consent to personal jurisdiction and venue in such courts.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, and the remaining provisions shall continue in full force and effect.

15. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and IRIS's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

16. Entire Agreement

These Terms, together with our Privacy Policy and any Client Services Agreement you may sign, constitute the entire agreement between you and IRIS regarding the use of our website and services. These Terms supersede any prior agreements or communications between you and IRIS regarding such subject matter.

17. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. If we make material changes to these Terms, we will notify you by updating the "Effective Date" at the top of these Terms and, where appropriate, providing additional notice. Your continued use of our website or services after any changes indicates your acceptance of the modified Terms.

18. Electronic Communications

By using our website and services, you consent to receiving electronic communications from us. These communications may include notices about your account, transactional information, and other information concerning or related to our services. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically satisfy any legal communication requirements.

19. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.

20. Force Majeure

IRIS shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, pandemic, epidemic, war, terrorism, riots, government action, power failures, or internet or telecommunications failures.
